Capital Gains Tax and Moving to Spain

Hi, I’m Chris Goodacre from Upsticks, and in this episode of the Upsticks Podcast, I’m joined by independent financial advisor Jeremy Ferguson to untangle the often-complicated financial aspects of moving to Spain. Whether you’re dreaming of a new life under the Spanish sun or just starting to plan your move, this episode is a must-listen.
One of the key topics we discuss is Spanish tax residency. It’s a crucial detail that’s often misunderstood—spending more than 183 days in Spain in a calendar year (January to December) makes you a Spanish tax resident. Timing is everything. If you sell your UK home in the same year you become a Spanish tax resident, you could be liable for Spanish capital gains tax, which ranges from 19% to 26%.
We also dive into how moving affects your pensions and savings. Did you know that UK tax-free pension lump sums become taxable in Spain? Or that UK ISAs lose their tax-free status once you’re a Spanish resident? These are just a few examples of the financial adjustments you’ll need to consider. On top of that, UK banks are increasingly closing accounts for non-residents, and UK financial advisors often can’t manage your pensions once you’ve left the country.
Jeremy also clears up some common misconceptions about the Non-Lucrative Visa (NLV). Contrary to some social media claims, it’s not just passive income that counts—savings can also be used to meet the financial requirements. However, since the NLV is intended for long-term residency, keeping a UK property as a fallback might not work in your favour.
This episode highlights the importance of professional financial advice—your individual circumstances are unique, and generic advice from social media can lead you astray. Jeremy and I cover practical tips, share real-world examples, and stress the need for solid planning to ensure your move to Spain goes as smoothly as possible.
