Apologies: The simple building block of an enduring and accountable workplace culture with Jon Bui, J.D
In this episode, we critically examined why apologies are often trivialised as mere interpersonal gestures, despite their significant legal and organisational implications. Within adversarial systems, apologies are frequently conflated with admissions of fault, creating a tension between expressing remorse and avoiding legal exposure.
Jon drew an important distinction between moral accountability and legal liability.
We further explored whether there is an apology law; its role, and its effectiveness in safeguarding individuals and organisations that express remorse, assessing whether such frameworks genuinely encourage openness or merely provide limited legal reassurance.
The discussion also addressed the organisational consequences of withheld apologies, particularly how leadership's reluctance to acknowledge harm can erode trust, damage workplace culture, and entrench conflict. In contrast, we identified the key elements of an apology within professional settings.
Finally, Jon analysed how power imbalances shape both the delivery and reception of apologies, demonstrating that in workplaces, credibility is often contingent not only on the content of the apology but also on the perceived authority and vulnerability of the speaker.

Tribute to Professor Robert A. Baruch Bush By Dr Chinwe Egbunike-Umegbolu
The passing of Robert A. Baruch Bush feels deeply personal both as a scholar and as someone formed, in part, by his ideas. For many of us in Alternative Dispute Resolution (ADR), the award-winning book, The Promise of Mediation: The Transformative Approach to Conflict, presented a fundamentally different vision from the dominant, settlement-driven paradigms of mediation. At a time when legal education often prioritises outcomes, efficiency, and closure, this book / his work invited us to slow down to see conflict not simply as a problem to be solved, but as a human interaction to be understood. Its central insight that mediation should be grounded in empowerment and recognition reshaped how many of us viewed justice itself. It challenged the assumption that resolution must be measured by agreement alone, and instead advanced the idea that transformation subtle, relational, deeply human may be the more meaningful outcome. I was drawn to his work as an LLM student in Dispute Resolution at Kingston University London where I returned to his ideas repeatedly in my family mediation assessments. There was something profoundly compelling about a model of dispute resolution that does not impose solutions, but intentionally creates a safe space: a space for voice, a space for dignity, a space for change. At the time, many of us particularly those trained within adversarial legal frameworks were captivated by the possibility that disputes could be addressed without confrontation, without the rigid architecture of the courtroom. We did not simply study the book; we were shaped by it. It gave us hope that peacemaking is not separate from justice, but a core part of it. Yet these encounters were never merely academic. His work demanded reflection. It invited questioning. It unsettled assumptions. It became something I carried with me into my PhD at the University of Brighton, and into my subsequent scholarship and teaching. I remain especially grateful to Pamela, my family mediation lecturer at Kingston University London, who introduced me to both family mediation and this remarkable sacred textbook. God bless her. That introduction was not simply academic; it was formative. What distinguishes Professor Bush’s contribution is not only its theoretical precision, but its humanity. He reminded us quietly but powerfully that mediation is, at its core, is about people. About how individuals understand themselves, about how they perceive one another, and about the possibility that, even in conflict, there can be recognition, growth, and transformation. This perspective has remained with me not only as a researcher, but as an educator. Each time I introduce his ideas to students, it feels less like teaching doctrine and more like opening a door into a different way of seeing conflict: one that privileges dignity over dominance, understanding over expediency, and transformation over mere settlement. Today, the transformative model Prof Bush championed has extended far beyond its original conceptual boundaries. It is now applied across diverse contexts family disputes, workplace conflicts, community tensions, organisational challenges, and even public policy dialogues. Yet its essence remains unchanged: a steadfast commitment to the moral and relational dimensions of human interaction. And so, his legacy continues/endures not only in books or citations, but in practice. In the mediator who chooses to listen more deeply, in the parties who begin, even tentatively, to see each other differently, in the quiet, often unseen moments where conflict shifts from destructive to constructive.

Beyond Resolution: Healing, Forgiveness, and the Future of Workplace Conflict with Prof Ken Cloke
In this episode, I was privileged to engage in a stimulating and thought-provoking podcast session with Professor Ken Cloke on Expert Views on ADR (EVA) Vid/Podcast Show.
Prof Ken is a world-recognised mediator (he currently lectures in Pittsburgh), dialogue facilitator, conflict resolution systems designer, teacher, public speaker, author of numerous books and articles, and a pioneer and leader in the field of mediation and conflict resolution for the last thirty-seven (37) years.
In 1983, he created the Center for Dispute Resolution in Santa Monica, CA.
In 2006, he co-founded Mediators Beyond Borders (MBB), based in Washington, D.C. MBB is an organisation that mobilises mediators worldwide to support individuals, organisations, communities, and governments in building conflict-resolution literacy and capacity in underserved communities.
Together, we analysed an important question: Is success in dispute resolution simply measured by settlement?
Prof. Cloke distinguishes between four critical concepts in conflict resolution: settlement, resolution, reconciliation, and transformation and challenges the assumption that ending a dispute necessarily means the conflict has truly been resolved.
We also raised an important concern is resolution sometimes just organisational conflict suppression?
In furtherance, we examined the role of forgivenessin conflict. Is forgiveness primarily a psychological act that occurs within individuals, or can it operate at a relationalor even institutional level?
We further examined the conditions that allow conflict to become transformative rather than destructive, offering insights relevant to workplace disputes, mediation practice, and broader social conflicts.
Drawing from his extensive global experience, Prof. Cloke reflects on his work in deeply polarised contexts, including Nigeria, Zimbabwe, Israel, and Palestine, sharing lessons from high-intensity conflicts that can inform how we approach disputes in organisations and communities.
Prof. Cloke also recounts moments where he witnessed forgiveness emerge organically in entrenched conflicts, and reflects on the conditions that made those extraordinary moments possible.
We also discussed why acknowledgement is often essential in divided societies and how this principle applies equally to workplace conflicts, where recognition of harm and experience can open pathways to healing.
Finally, Prof Cloke shared what has surprised him most about human beings in conflicand the remarkable capacity people have for healing, transformation, and reconciliation.
This episode offers insights for mediators, lawyers, organisational leaders, HR, academics, and anyone interested in the human dynamics of conflict and peacebuilding.

Our analysis illuminated how holding onto resentment can inflict pain and obstruct the healing process. We distinguished conceptually between healing and Alternative Dispute Resolution (ADR) mechanisms. Stephen clarified that while ADR procedures such as mediation, conciliation, and restorative justice provide structured pathways to settlement, healing entails deeper psychological and relational restoration. We evaluated whether Human Resources (HR) could integrate forgiveness within grievance procedures while upholding procedural fairness. Stephen addressed a common misconception that forgiveness equates to tolerating mistreatment, highlighting the importance of maintaining personal boundaries. Chinwe raised a pertinent question: Should forgiveness-based approaches be optional or mandatory steps in the dispute resolution process? Furthermore, we highlighted the common obstacles that impede employees from reporting, such as fear of retaliation from the organisation or employer.

Dr. Dawn also shared the exciting news that plans are underway to establish a Chartered Institute of Arbitrators (Ciarb) center in Grenada, which promises to further strengthen the ADR framework in the region.We highlighted that some institutions and organisations in the CC regions or jurisdictions have yet to embrace ADR. For instance, in Trinidad, the sectors mentioned above could greatly benefit from establishing an ombudsman or mediator's office in each department. Additionally, incorporating ADR provisions in the employment contracts to settle disputes between employers and employees as soon as possible could foster a more harmonious work environment. This proactive approach will curb the escalation of conflict or disputes and improve workplace relations.
Further, Dr Dawn indicated the future of international legal research in ADR; in the CC jurisdictions, specifically Grenada, St Kitts, and Nevis. In this series, Tony explored Bentham’s critiques of the legal system of Bentham's era and compared those insights to our current legal framework, highlighting how many of his ideas remain applicable today. We also included perspectives from his mentees, particularly the valuable contributions of John Stuart Mill and others.
Additionally, we discussed the application of utilitarianism in mass mediation. This approach is non-binary and flexible, making it one of the most preferred ADR methods. Tony's overarching argument is that the outcomes for parties involved in disputes would often be more favourable if they chose mediation over traditional binary methods. For example, consider the implications of processing hundreds of thousands of cases through pre-court mandatory mediation—would there be sufficient mediators and mediation advocates to manage such a workload?
Moreover, we examined whether the mediation process is prearranged as it has been in England and Wales, utilising telephone and email—both technologies dating back to the 20th century.
This highlights the necessity for innovation in legal technology; on a larger scale, we must assess success through clear criteria. For instance, are we effectively reducing waiting times and hearing durations? While resolving cases may be expedient, we must also consider parties' satisfaction levels with these resolutions.
Tony revealed that Bentham’s philosophical or hedonistic calculus underscores the need for empirical and quantitative evidence, demonstrating the potential role of legal technology in enhancing our understanding of mediation outcomes. To achieve this, Tony suggested that ADR centres implement routine evaluations at the outset and reassess after two years to gauge progress and effectiveness. Chinwe also emphasised the importance of funding and raising awareness. If the government in England & Wales & other jurisdictions actively supports ADR, it will stand the taste of time.
Chinwe likened Jeremy Bentham to Nostradamus, who foresaw future events. This comparison positions Bentham as a visionary whose ideas or thoughts on justice now align with contemporary methods of conflict resolution, such as ADR.Tony expressed his appreciation for the empirical data on public awareness from various states in the U.S. presented in my book, 'Appropriate Dispute Resolution in Comparative Perspectives in Nigeria, the U.S., and the UK.' This evidence serves as a strong foundation for advocating greater investment in and awareness of ADR processes.

In this series, we explored various aspects of family mediation and its role in resolving conflicts. We examined cohabitation and revealed the impacts of power Imbalances in Family Mediation. In furtherance, we discussed the potential for mediating cases involving domestic violence (DV). We analysed the legal enforceability of prenuptial and postnuptial agreements, providing guidance for potential users and those interested in pursuing a career in family mediation.We also scrutinised the future of legal research via podcasts, particularly in mediation while revealing five tips for crafting an effective introductory mediation statement.Finally, we revealed why Ashley.A. I was privileged to engage in a stimulating and thought-provoking conversation with Jonathan Wood, FCIArb, on Expert Views on ADR (EVA) Vid/Podcast Show. He was the president of the Chartered Institute of Arbitrators (Ciarb)-at the time we recorded the interview. He has in-depth knowledge and understanding of Ciarb, having served five (5) years as Chair of the Board of Trustees and eight (8) years as a Trustee. In this series, we analysed the role of Appropriate Dispute Resolution (ADR), specifically mediation and Arbitration, in resolving conflicts or disputes and how far they have enhanced access to Justice in the UK.
Mr Wood highlighted that ADR is an acronym for Alternative Dispute Resolution, and what it means in broad terms is that it is an 'Alternative' in resolving disputes outside the court system; it is a non-court system process of resolving disputes.
He indicated that it is an acronym first coined by Professor Frank Sander, an American academic, in 1976 and was first mentioned to the Chartered Institute of Arbitrators (CIArb) at a conference by again an American academic, Jonathan Marx, in 1983. We alluded to the fact that, universally, Mediation is a well-known form of resolving disputes outside the court system. On the one hand, Arbitration as an ADR mechanism is different in various jurisdictions. For instance, arbitration is considered a binding adjudicative process in the USA, while the UK view includes mediation, arbitration, early neutral evaluation, and adjudication under the remit of ADR. Mr Wood emphasised that he stands with the English perspective- that arbitration falls within the remit of ADR, recounting his experiences with the Turkish government, where concepts like mediation and arbitration were challenging to distinguish; he came up with an alternative description, 'facilitative negotiation.' We critically analysed the recent case of Churchill v Merthyr Tydfil Borough Council [2023] EWCA Civ 1416, which emerged in the Court of Appeal, UK, overturning doubts cast by a previous case, Halsey, about the court's power to mandate mediation with cost sanctions against recalcitrant or uncooperative parties. The basis of that objection is that it might infringe on Article 6 of the European Convention on Human Rights, which provides the right to a fair trial. It is imperative to state that it was a case in which the Chartered Institute of Arbitrators (CIArb) intervened with a number of others to try and educate the court on the very important role of mediation. The outcome of the case led the foundation to enable the court to order the parties to undergo mediation and to stay proceedings whilst they did so. As a result, the Civil Procedure Rules (CPR) in the UK have now been changed to allow that to happen in appropriate and proportionate cases; a cost sanction can now be ordered by the court against the party who is recalcitrant or does not want to engage in mediation in good faith. That has heralded a new era of mediation in the UK, which goes hand in glove with access to justice. Mr Wood indicated that justice has become increasingly expensive in courts, while mediation offers a more affordable and expedited solution, which, in turn, enhances access to justice. He revealed the historical development of CIArb and why they might change its name in the future to include 'Mediation.' Our analysis focused on Bentham’s influential work, ‘An Introduction to the Principles of Morals and Legislation,’ examining the ‘hedonistic calculus’, which Bentham introduced as a method for evaluating the 'moral rightness of actions based on their consequences for happiness.' Chinwe suggested that Bentham’s advocacy for a swift justice system was a call for Appropriate /Alternative Dispute Resolution (ADR). Despite not explicitly mentioning ADR, his ideas resonate with the principles of efficiency and accessibility in resolving disputes. Tony examined Bentham’s critiques of the legal system of his time and compared those insights to the current state of the legal system, revealing that his ideas remain relevant today. We also incorporated insights from his mentees, particularly the contributions of John Stuart Mills, amongst others. Chinwe likened Bentham to Nostradamus, who foresaw future events. This comparison positions Bentham as a visionary whose ideas or thoughts on justice now align with contemporary methods of conflict resolution, such as ADR. To reiterate, Bentham's utilitarian principles emphasise ‘the greatest good for the greatest number.’ However, Tony explained why Bentham’s utilitarian principle of utilitarianism can be perceived or seen as a moral and immoral theory. We concluded that Jeremy Bentham’s utilitarianism can enhance the effectiveness of ADR as a viable stand-alone option. Drawing from his own experiences with these issues, he highlighted the cultural nuances that contribute to such problems. He emphasised how fostering fairness in the workplace can help prevent or mitigate these behaviours. Blaine explained that there is a direct connection between fairness and conflict.
He pointed out that all conflicts begin with a perceived injurious event. But how does an event come to be perceived as injurious? This is where the concept of fairness becomes relevant.
Further, he explained that Fairness requires three (3) key elements from an organisation: communication, collaboration, and proactive thinking. For example, if I feel disrespected because someone else failed to do their job, that situation represents a potentially perceived injurious event. Chinwe highlighted that this is not the case in some organizations / Institutions; the leaders and HR are not usually fair. Finally, Blaine acknowledged that workplaces globally often resemble the master-and-servant relationships of the medieval period, which bestow significant power upon employers while requiring obedience from employees.

He is the Chief Judge of the Tax Appeal Court of Trinidad and Tobago, which he has chaired for the past twenty years. Justice Dr Gafoor provided an overview of the history and evolution of ADR practices within the CC region with a particular focus on Trinidad and Tobago (TT). He highlighted the fact that these practices were already in place amongst the Indigenous people in TT prior to the introduction of the court system.
We examined the benefits and challenges associated with implementing ADR in Trinidad and Tobago, along with the current laws and regulations governing its practice.
Justice Dr Gafoor pointed out that using ADR lowers costs and reduces the time spent compared to traditional court cases.
Furthermore, he revealed the level of awareness among employees in TT regarding ADR options for workplace disputes or conflicts and issues such as discrimination, bullying, and harassment in the workplace.
Justice Gafoor also offered a forward-looking perspective on the future of international legal research in TT, especially as it pertains to ADR.
In conclusion, he emphasised the proactive initiatives and programs established by the Chartered Institute of Arbitration to promote ADR across the CC region, reinforcing the importance of these practices in building a more just and equitable society.

We indicated that disputes can escalate because many believe a conflict must involve naming, blaming, and claiming; however, this viewpoint describes a dispute. Blaine further stated that recognising this distinction enhances people's understanding of psychological safety at the workplace. Rather than viewing conflict as only arising between two parties; employers and employees can appreciate the nuances of workplace dynamics, paving the way for more constructive dialogue and resolution. Additionally, we examined the laws and regulations in Canada concerning workplace discrimination, harassment, and bullying while critically analysing how cultural nuances can contribute to the prevention of workplace conflict. Blaine revealed that a "host culture" exists in Canada, where a specific group within the workplace holds more rights and freedoms than others. Although harassment policies are designed to apply equally to all, in practice, they often fail to do so, fostering a culture of fear among those who have the right to speak out. This raises a pertinent question: 'What is necessary to ensure workplace safety? Blaine revealed that to feel comfortable addressing these behaviours encountered at the workplace, individuals or employees need involvement, influence, choice, agency, peer support, and confidentiality—elements that collectively foster a sense of full citizenship. Unfortunately, the above-mentioned cultural factors in some workplaces may discourage individuals or employees from feeling safe enough to express concerns about bullying, discrimination, and harassment. Series 5: Creating Safe Spaces Via ADR: How can Employees in the US Report Discrimination, Harassment & Bullying without fear of losing their jobs with Ed Watt
I was privileged to engage in a stimulating and thought-provoking conversation with Ed Watt on Expert Views on ADR (EVA) Vid/Podcast Show. He started his forty (40) year career in transportation as a front-line worker at the New York City Transit Authority (NYCTA). He rose to the position of Financial Secretary of the largest transit local in North America.

Mr. Watt provided a lucid definition of a toxic workplace and elaborated on its connection to Donna Hick's theory for remedying Toxic work environments. We explored the legal framework and employer's obligations to prevent and address workplace discrimination, bullying, and harassment while examining strategies to encourage reporting these incidents through ADR. Additionally, we highlighted common barriers that deter employees from reporting, such as the fear of retaliation from HR/organisation or their employers. Ed contributed insightful perspectives on how organisations can foster a culture of inclusion and diversity that empowers employees to report bullying, discrimination, or harassment. He offered insights from his encounter/ experience with bullying, discrimination, and harassment, highlighting the cultural factors that play a role in these issues. He specifically delved into the impact of broader cultural influences, citing immigration and using the US and UK as examples. We’re Here to Help: When Guardianship Goes Wrong with Author ‘Diane Dimond’- Can ADR Help?

In this episode, Chinwe provided valuable insights into ‘We're Here to Help: When Guardianship Goes Wrong’ and offered a clear definition of mediation. She conducted thorough research using primary and secondary resources, including email interviews and analysis of articles and books. The interviews were conducted with leaders in the legal and alternative dispute resolution (ADR) field to assess the viability of ADR in settling guardianship or conservatorship cases. Based on the research, Chinwe concluded that Appropriate Dispute Resolution (ADR), specifically Early Dispute Resolution (EDR) and mediation, could be effective in such cases. She emphasised the 'special considerations' that mediators must consider when mediating such disputes. Diane also provided insights into the motivations behind writing the #book .
Furthermore, we explored the absence of #laws allowing guardianship or conservatorship cases to be resolved through ADR before proceeding to the courts. We also examined why the law permits individuals other than family members to assume responsibility for vulnerable individuals and highlighted cases where guardianship was considered necessary but not granted. Diane revealed that there are lots of lovely people in the system, but for the predators, it is all about the money. For example (see chapter 11 of the book), for the judge to keep the case of Eric Kramer, an NFL Quarterback player, open, they had a hearing on whether or not there should be a guardianship or whether the girlfriend was stealing money from him. She revealed that every time there was a hearing, it cost Eric Kramer's confiscated money; it is imperative to state that the courts get all his money every hearing. According to Diane, it cost about $88,000, equivalent to 69,117.19 pounds sterling, and there were multiple hearings every single month for years. Eric revealed to her that this caused him to lose a lot of money. He estimates that he lost about $800,000, equivalent to 628,338.08 Pound sterling, in the court system without receiving the protection he needed. This raises a significant question: Are such practices in the court legal? Unfortunately, Diane revealed that they are because the person in the middle of all this, the ward of the court, is incapacitated and, therefore, unable to hire their own lawyer to fight for them (See Chapter 11 and Chapter 6). We also discussed how guardianship focuses on financial gain for some within the system, yet we acknowledged the presence of many compassionate individuals within the system. Diane also pointed out that guardianship can be used as a tactic to force the end of marriages (see Chapter 9). For instance, some men may want to divorce their wives, but their wives do not want to be #divorced. In these cases, their lawyers may recommend obtaining #guardianship over the wife, making it difficult for her to hire a lawyer to contest the divorce. Diane emphasised that this practice is legal because it is carried out under the guise of a court order (See Chapter 9 of the book for more details).
In further support of the previous point, she highlighted specific examples demonstrating how families have been negatively impacted by the extensive powers wielded by #guardians. For instance, guardians can ban any family member causing problems, and pursuing legal options to resolve these disagreements may not be financially feasible for many individuals.

In this episode, we delved into the Dispute Resolution operations at the City University of New York (CUNY) examining its objectives, methods, and the challenges faced in establishing the program and the center. We provided insight into the state of ADR in New York, at the time and how ADR has enhanced access to justice in the United States.
Furthermore, we shed light on the significant interest in the ADR educational sector in New York and the profound role and impact of the center not only on the community in New York but also on the broader public beyond New York.
Prof Maria emphasised that ADR should be mandatory or compulsory in schools while revealing the most remarkable achievements of the center, revealing its dedication to diversity and inclusiveness. Finally, we explored the courses and certificates that they offer and discussed the center's initiatives to educate the public about the benefits of ADR and attract potential users.

During my time in Hamtramck, I had the privilege of participating in a stimulating and thought-provoking podcast with Dwydell Garrett, the son of Sarah Sims Garrett. He shared with me the details of a landmark case that lasted over five (5) decades, from 1968 to 2024 - the case of Sarah Sims Garrett et al. v City of Hamtramck.
The case has far-reaching implications for housing disputes in the US and highlights the resilience of the Garrett family and others involved in the class action. Dwydell--------I believe this case has resulted in a fairer outcome for low-income individuals. It seems that many companies take advantage of the lower class to benefit the wealthier class. However, the community and its people are essential for the city to thrive. They pay taxes and water bills, and without them, the city cannot function. We examined the interconnectedness between ADR and housing-related issues, assessing its suitability and exploring the extent of housing dispute backlogs in the US. Also, we discussed the potential of ADR in alleviating these backlogs in the US courts. Dr Chinwe shared an excerpt from an article on the City and County of San Francisco Government page, underscoring ‘how ADR can be used to settle Housing issues outside the rent ordinance and those that fall under the Rent Ordinance.’ This prompted a discussion about the practical application of this law and its potential applicability in other parts of the US, with Alec providing a comprehensive overview of its implementation in some states.
Against this backdrop, we outlined the step-by-step process for parties to initiate a housing settlement via ADR while scrutinising the eligibility of landlords and tenants to utilise ADR for dispute resolution.
Finally, Alec provided a comprehensive analysis of the benefits and drawbacks of employing ADR to address housing disputes or conflicts and highlighted the necessity for more collaboration among ADR organisations/sections to improve public awareness of the above subject matter.

This method was the main mode of settling disputes in most African #countries prior to #British #colonisation, which ushered in #litigation- with reference to #Uganda and #Nigeria. We examined the impact of Appropriate / Alternative Dispute Resolution (ADR), along with the role of technology in improving access to justice in England and Wales. Our discussion also delved into the purpose and impact of DisputesEfiling.com (DEF), including a brief analysis of the recent case of Churchill v Merthyr Tydfil, and we raised a pertinent question: Does the creation of DEF software suggest a growing interest in ADR? Tony presented data-driven examples to analyse the above-mentioned question while indicating the effectiveness of DEF compared to other similar products. We also indicated the cost of downloading DEF software and what measures are in place to prioritise the security and confidentiality of registered practitioners. We went on to revisit Dr Chinwe’s 2020-2021 research findings, one of which revealed room for improvement in lawyers' adoption of ADR across various jurisdictions. Tony shed light on the current situation. In conclusion, Tony critically analysed AI's role in dispute resolution and its impact on the ADR industry in England and Wales.

I was privileged to engage in a stimulating and thought-provoking conversation with the 'ADR Legend' Kenneth Cloke, on his latest book ', The Magic in Mediation', on Expert Views on ADR (EVA) Show. Professor Ken Cloke is the Director of the Center for Dispute Resolution. He is a mediator, arbitrator, consultant, and trainer specialising in communication, negotiation, and resolving complex multi-party conflicts. He has mediated conflicts and taught dispute resolution in over Twenty (20) countries. He is currently an Adjunct Professor at Pepperdine University School of Law, Harvard University School of Law and Amsterdam University Institute on Dispute Resolution. He is an internationally recognised speaker and has authored several books. We went ahead to analyse the book chapter by chapter; Ken dealt with questions raised from Chapter 1, specifically 'why mediators should not be neutral and why omni-partiality.' He provided examples to support his point. Prof also addressed questions from Chapter 4 regarding 'the art of asking questions' and 'whether mediation can be used to tackle bullying,' using the conflict in Gaza as an illustration. Subsequently, Ken answered questions from Chapters 6 and 7, which explore the links between mediation, physics, and mathematics. He then delved into Chapter 14, examining mediating death, dying, trauma, and renewal, illustrating his close brush with death and Chapter 11, which highlighted the conflict in Ukraine, using examples from Israel and Iran. Additionally, he critically analysed questions from Chapter 10, which focuses on the topics of colonization, decolonization, and indigenous restorative practices. Finally, he ended with his own ideas on searching for ways of finding, feeding and FORMENTING MAGIC. I highly recommend Ken's book, 'The Magic in Mediation,' as his writing prowess is unparalleled. Series 3-ADR and Ombuds: A US Perspective with Megan P. Willoughby

Meg, a key contributor to the drafting of Resolution 500, revealed a detailed analysis of the recent adoption of the resolution by the ABA House of Delegates. The resolution strongly recommends 'the use of Early Dispute Resolution (EDR), which consists of non-adjudicative methods for resolving disputes in a cost-effective and timely manner. These methods include direct negotiation, ombuds and mediation.'In addition, we delved into the different types of ombuds, analysing the measurable differences in cost and time compared to litigation and other Appropriate Dispute Resolution (ADR) processes. Meg shed light on the role and independence of the ombuds in conflict resolution and the pros and cons associated with this approach. She also explored the scope of matters that can be resolved via ombuds, examining its role in #institutions, #organisations, #highereducation and #healthcare . We provided examples of when an #ombudsman or #ombudsperson can maintain #confidentiality , as well as situations when this may not apply or exceptions to this general rule. We also covered the qualifications required to become an ombuds and the future of Mass Advocacy of ADR.

Asian International Arbitration Center (AIAC) with Director Datuk Sundra Rajoo
I had the privilege to engage in a stimulating and thought-provoking conversation with Director Datuk Sundra Rajoo on the Expert Views on ADR (EVA) Vid/Podcast Show. He is the current Director of the Asian International Arbitration Centre (AIAC) and president of the Asian Institute of Alternative Dispute Resolution (AIADR). He is a Certified International ADR Practitioner (AIADR) and Chartered Arbitrator. He played an active role in transforming the AIAC into a sought-after arbitration centre in the Asian region, where the centre’s caseload grew massively from Twenty-Two (22) arbitration cases in 2010 to an accumulative total of Two Thousand Seven Hundred Sixty-One (2761) arbitration, adjudication and mediation cases in 2019. Datuk Sundra is the Founding President of the Sports Law Association of Malaysia, Founding President of the Society of Construction Law, Malaysia and the Malaysian Society of Adjudicators, and Past President of the Asia Pacific Regional Arbitration Grouping (APRAG). He is an Advocate & #solicitor of the High Court of Malaya, a Registered Professional Architect, a Registered Town Planner, and a Fellow of the Royal Institution of Surveyors. Oakland Mediation Center (OMC) with Executive Director Charity Burke
I had the honour and privilege of interviewing Charity Burke on Expert Views on ADR (EVA) Vid / Podcast Show. Charity is the Executive Director of the Oakland Mediation Center (OMC). She has created several conflict resolution and advanced mediation training programs for the general public, volunteers at OMC, and community members involved in special education. With over Twenty (20) years of multi-state experience in mediation, she has successfully mediated hundreds of cases, including personal injury, special education, pre-and post-judgment divorce, adult/child guardianship, EEOC, civil rights, general civil matters, landlord/tenant, and employment. In this episode, we delved into the critical role of mediation in resolving conflict. We then explored the Oakland Mediation Centre (OMC), including its background, purpose, and operational procedures, as well as the various programs it offers, such as the Mental Health Mediation program developed for the state of Michigan and the effectiveness of Mediation in special education. Furthermore, we examined the concept of peer mediation and the potential advantages of implementing peer mediation programs. We scrutinised the selection process for student participants and what preventive measures are in place for the data of practitioners registered or who would register with the center. Our discussion also touched on the significant impact of mediation in Oakland and the United States, including how far it has enhanced access to justice and the promotion of diversity and inclusivity in the center. We compared the cost and time involved in settling disputes via mediation compared to litigation and concluded. Finally, Charity revealed the training services offered or provided by the OMC to help practitioners and potential mediators hone their skills in mediation and conflict resolution. Series 2: Vous Parlez #adr Washington DC! #findings with podcaster Ayssia Mason
My recent research on the streets of Washington, DC, indicates that Appropriate /Alternative Dispute Resolution (ADR) may not be as widely known as previously assumed. The study covered various well-known areas, including the White House, United States Supreme Court, Dupont Circle, Massachusetts Avenue, Washington Hilton, Generator Hostel, Connecticut Avenue N.W., Pennsylvania Avenue, and Capitol Hill. The findings reveal that there is still a lack of awareness regarding ADR among the general public. This was highlighted by Ayssia Mason, a prominent podcast host of 'From the Hood up' / 'Always the Topic', who demonstrated a lack of familiarity with ADR. Before joining CU Boulder, Liz served as Arizona Assistant Attorney General, Assistant Ombudsman for the State of Arizona and Ombudsman for Apollo Education Group. She is a trained mediator and Certified Organizational Ombudsman Practitioner (CO-OP).

She is a Professor of Law at the University of Nebraska and an adjunct/Affiliated Professor at Mitchell Hamline School of Law. Professor Blankley researches in the areas of alternative dispute resolution, legal ethics, and the intersection of ethics and dispute resolution.
